CNN Wins Court Order Restoring White House Reporter’s Access

A federal judge on Friday ruled that the White House violated CNN reporter Jim Acosta's Fifth Amendment rights when it revoked his press credential last week, and ordered the Trump administration to reinstate Acosta's press pass "immediately".

CNN claimed that it and Acosta have a First Amendment right to the press pass.

Kelly criticized the USA government's action, commenting that CNN is likely to prevail in demonstrating the reporter was denied due process in the credential revocation process.

This was also granted on a limited basis and was not on First Amendment ground, but the Fifth Amendment's right to due process.

CNN and Jim Acosta sued for a temporary restraining order requiring the White House to return or reissue Acosta's press pass.

He said he was grateful for the judge's ruling, that it was a test and the media passed the test.

"Great day for journalism and the First Amendment!", said CNN's lawyers while Acosta emerged from the courthouse, thanked his colleagues in the media and the judge and then closed off with "let's get back to work!"

The White House allowed reporters into a bill signing on cyber security at the Oval Office on Friday, after the event was initially closed to the press. "There's no First Amendment right".

"If the president wants to exclude all reporters from White House grounds he clearly has the authority to do that", said James Burnham, deputy assistant attorney general.

Trump said his team now is "writing up rules and regulations" to "set up a certain standard" for behavior on White House grounds, insisting "We have to practice decorum".

Lindsay Walters may not be a well-known public figure, but she would certainly have been recognized in a room full of White House reporters.

"The White House surely hoped that expelling a reporter would deter forceful questioning, but the court's ruling will have the opposite effect".

He also agreed with CNN's argument that the White House did not provide due process.

As WND reported, at the news conference Acosta began by challenging Trump's description of the Central American caravan as an "invasion".

The White House pulled Mr. Acosta's credentials hours later.

"If I think somebody is acting out of sorts I will leave, I will say 'Thank you very much everybody, I appreciate you coming, ' and I'll leave", Trump said. "We will, however, never tolerate a reporter placing his hands on a young woman just trying to do her job as a White House intern". Even if Trump had ended up trying to take that person's press pass away for asking tough questions, that would have been a higher hill to fight on than the one they now occupy, which is essentially about nothing grander than Acosta's right to interrupt his colleagues. Thirteen news organisations, including the Washington Post and Fox News, said Wednesday they would jointly file a friend-of-the-court brief supporting CNN's position.
