The Trump Presidency: NYT: Trump recorded discussing secret payment

"The significance of this tape is that it may indicate there was criminal conduct by either President Trump or Michael Cohen or both of them", Specter explained. It is unclear why Team Trump would waive its privilege on the recordings.

A self-described fixer for Trump for more than a decade, Cohen said previous year he would "take a bullet" for the president.

"Nothing in that conversation suggests that he had any knowledge of [the AMI payment] in advance", Giuliani said.

"In the big scheme of things, it's powerful exculpatory evidence", Mr. Giuliani said.

The Wall Street Journal reports that the taped September 2016 conversation took place in person rather than over the phone, and the recording cut off after less than two minutes.

A spokeswoman for the U.S. attorney's office and Cohen declined to comment.

Prosecutors have indicated that they are probing questions about how the payments were made before the 2016 elections - and whether any of the transactions could run afoul of federal campaign finance laws.

The FBI is also investigating Cohen's payment of $130,000 to adult film star Stormy Daniels in the weeks leading up to the election in exchange for silence about an alleged one-time encounter with Trump.

Trump has previously sought to play down reports that Cohen could turn on him despite his ongoing legal battles.

He asks Cohen how they would pursue buying the rights.

He was also the face of Vote Leave - the official pro-Brexit campaign group that was recently fined for breaking electoral law by overspending nearly US$600,000.

The recording is sure to raise new questions about what the president knew about the payments and when.

In response, Cohen attorney Davis tweeted, "The strategy of @realdonaldtrump @potus @RudyGiuliani is flawed; just as is #Trump's false #Twitter statement made against @michaelcohen212 this morning".

Cohen had made a practice of recording telephone conversations, unbeknownst to those he was speaking with.

This gives the government access to the recording as part of the United States attorney for the Southern District of NY investigation into Cohen. Later Lanny Davis, Cohen's newest attorney, put out a statement claiming that "when the recording is heard, it will not hurt Michael Cohen. And any attempt to spin can not change what is on the tape".

"Inconceivable that the government would break into a lawyer's office (early in the morning) - nearly unheard of", Trump wrote on Twitter Saturday morning.

Rudy Giuliani, Trump's current personal attorney, confirmed to the Times that the Cohen tape existed, but said it showed the president had done nothing wrong.

The investigation "seems intent on damaging the Republican Party's chances in the November Election", Trump tweeted, referring to the upcoming midterm congressional polls. Specifically, the Federal Bureau of Investigation is looking into payments to Karen McDougal, a Playboy model, and Stormy Daniels, the adult film star, to stifle embarrassing news stories ahead of the election.

"We have no knowledge of any of this", she said.

Ms Daniels says she and Mr Trump had sex in a hotel room in Lake Tahoe, a resort area between California and Nevada, in 2006. She said that she turned down the offer and that she began a relationship that included interactions between the two "many dozens of times".

She filed a lawsuit against AMI this year seeking to regain the rights to her story and settled with the company in April. She declined to comment further.
