The Trump administration was working on final background checks for another five children ahead of Tuesday's (Wednesday NZT) deadline.

More than 2,000 children in all were separated from their parents by United States immigration authorities at the border this spring before President Donald Trump reversed course on June 20 amid an worldwide outcry and said families should remain together.

Justice Department lawyers had filed an application to U.S. District Judge Dolly Gee more than a week ago seeking her approval to detain parents and their children together for unspecified periods of time.

The government has reportedly struggled to offer exact information about the number of children separated from their parents.

"The court has a range of options from significant fines to other types of relief", said ACLU attorney Lee Gelernt.
