Trump revokes Obama policy using race in school admissions

President Donald Trump's administration is planning to undo policies that would encourage race as a factor in college admissions, according to news reports.

While the Supreme Court has affirmed the practice of affirmative action a few times, the issue could be revisited if Trump's Supreme Court nominee views the practice differently than his predecessor, Justice Anthony Kennedy. Conservatives have argued such programs can hurt whites and Asian-Americans.

The guidelines, put in place by the administration of President Barack Obama in 2011 and 2016, put forth legal recommendations that Trump officials contend 'mislead schools to believe that legal forms of affirmative action are simpler to achieve than the law allows, ' the Journal reported, citing two people familiar with the plans.

"The Trump administration isn't just willfully blind to the reality of systemic racism - it's coldly indifferent to its destructive consequences, and it's absolutely committed to dismantling any efforts to address our nation's original sin", Democratic National Committe Chairman Tom Perez said in a statement.

The guidance that will be reversed Tuesday provided examples of different educational contexts within which institutions could permissibly consider race.

Peter McDonough, vice president and general counsel of the American Council on Education, which represents college and university presidents, said he doubted schools would change admission policies based exclusively on Tuesday's announcement.

"I'm pleased that the Supreme Court upheld the basic notion that diversity is an important value in our society", President Obama told reporters at the White House after the 2016 ruling.

McDonough said the action could have a chilling effect on colleges as they review their admission methods.

Ultimately, it should not come as a surprise that the Trump administration would rescind these guidelines, said Tomiko Brown-Nagin, the dean of the Radcliffe Institute for Advanced Study at Harvard and a constitutional law expert.
