Trial still on: Judge does not dismiss charge against Greitens

Greitens is facing a growing chorus of calls for his resignation, including by Missouri Attorney General Josh Hawley, a Republican running to unseat U.S. Sen.

Hawley, who is seeking the Republican nomination for the US Senate race challenging incumbent Democrat Claire McCaskill, said the decision to charge Greitens is ultimately that of St. Louis circuit attorney Kim Gardner, the local prosecutor in the place where the purported criminal acts were committed, and he stressed that the deadline of the statute of limitations is fast approaching.

Republican Speaker of the House Todd Richardson said Thursday that a substantial number of Republicans had signed a petition calling for a special session to consider the impeachment of the governor.

A spokeswoman for Gardner said St. Louis prosecutors met with officials from the attorney general's office Monday and are "reviewing the evidence" related to The Mission Continues donor list.

Greitens' trial is scheduled for May 14.

In the invasion of privacy case, attorneys for Greitens contend that investigator William Tisaby has repeatedly lied to the court.

Meanwhile, Greitens faces the possibility of impeachment over the same scandal.

Greitens was indicted in February on one count of invasion of privacy. "And last week, a detailed investigation by the Missouri House painted the former Navy SEAL as being sexually and physically abusive in the affair". Greitens has admitted to the affair but denied criminal wrongdoing. And he's made it clear for months that he's not going to resign. He's accused of taking a nonconsensual photo of a partially nude woman with whom he had an affair in 2015, before he was elected. Burlison said he might throw the case out in the event of further violations, but only if there is "irreparable" unfairness toward the defendant, Greitens.

Prosecutors do not have the photo in their possession.

Attorneys for Greitens say a private investigator hired by the prosecutor has repeatedly lied to the court.

The judge agreed that the prosecution's conduct "is not to be condoned and it is serious". His ruling allows defense attorneys to re-depose witnesses in light of new evidence in the case belatedly disclosed under pressure. They said the defense claims were part of a public relations strategy, and in a statement late Wednesday called claims of a perjury investigation part of the "bullying efforts" of Greitens, his lawyers and his public relations team. "Under Missouri law, this is known as computer tampering and given the value of the list in question, it is a felony", Hawley said.

On Tuesday, Hawley alleged "that Greitens took a list of donors to his military veterans charity, transferred it to his political campaign, and used it for political fundraising", as we reported.

The Republican governor's legal team last week accused St. Louis Circuit Attorney Kim Gardner, a Democrat, of prosecutorial misconduct, saying she tried to hide video evidence supporting the governor and his assertions that the affair was entirely consensual.
