Justices allow Trump administration ban on most refugees

This is the most recent decision in a series of legal battles stemming from the Trump administration's travel ban against six Muslim-majority countries and an indefinite ban against refugees.

US officials can at least temporarily continue to block refugees with formal assurances from resettlement agencies from entering the United States after the Supreme Court intervened again Monday to save a piece of President Trump's travel ban.

The objection to Trump's travel ban most frequently cited by Watson and U.S. District Judge Theodore D. Chuang in Maryland (the other judge who issued a ruling last March blocking sections of Trump's executive order) was that the order amounted to a ban on Muslims entering the United States.

The ruling on refugees "will disrupt the status quo and frustrate orderly implementation of the order's refugee provisions that this court made clear months ago could take effect", acting U.S. Solicitor General Jeffrey Wall wrote.

On Tuesday, the Supreme Court sided with the administration in continuing to ban nearly all refugees from entering before the court takes up the full Muslim travel ban in October. The justices also said the ban should not apply to visitors who have a "bona fide relationship" with organizations or people including those with close family ties or a job offer. The order said explicitly that the entry of the refugees was being allowed "pending further order of this court". The question is whether a formal assurance from a refugee-resettlement agency establishes a "bona fide relationship" between a potential refugee and an American entity.

Next month, the high court is scheduled to hear arguments on the legality of Trump's travel ban.

But its specific wording - and the fact that the Justices had acted on only one of a series of new requests by the Administration - suggested that the court was giving itself the option of reexamining the issue within the next few days, or perhaps later.

SCOTUS will take up the travel ban beginning October 10, where they will begin hearings to determine whether the order as a whole is constitutional.

On the other hand, the court said, relationships formed for the objective of evading the travel ban did not count. The Trump administration had stated that the temporary ban would give officials time to assess US vetting procedures and would address the risk that terrorists could slip into the country. At the Supreme Court, the government challenged only the part of the appeals court's ruling concerning refugees, arguing that there is no direct connection between refugees and resettlement agencies.

Within hours, Justice Kennedy granted the request, staying the Ninth Circuit's decision from going into effect and ordering Hawaii to file a response by noon on Tuesday.
