Trump in a memo last Friday directed the Department of Defense to stop accepting transgender people who enlist for military service.

The plaintiffs claim the ban violates the equal-protection and due-process guarantees under the Fifth Amendment, as well free speech rights.

The ACLU tweeted that it is also representing six service members "hurt by #TransMilitaryBan".

The ACLU said the decision to implement the ban was based off Trump's "judgment", which "appears to reflect nothing more than the uninformed speculation, myths and stereotypes that have already been rebutted by an extensive and rigorous evidence-based process". And not all transgender soldiers would even seek treatment related to their gender. Trump cited concerns over "tremendous medical costs and disruption that transgender in the military would entail".

Senator John McCain slammed President Donald Trump's order banning banning transgender people from entering the military.

Plaintiffs include both transgender people who are now serving in the military, and transgender people who wish to serve but are no longer able to because of the ban.

Trump announced the ban in a series of Twitter posts on July 26, reversing a policy of his predecessor, Barack Obama.

Before the policy change by the Obama administration, the Pentagon had concluded that there was no basis for the military to exclude transgender people, as long as they could meet the same fitness requirements as other members of the military.

He had earlier announced his plans on Twitter to ban transgender people from the armed forces. It leaves determining what will happen to transgender individuals now serving to the Defense Defense.
