House committee votes to hold Clinton IT aide in contempt

House Democrats said the contempt resolution was created to hurt Clinton's presidential bid against GOP rival Donald Trump.

The move comes after Pagliano earlier ignored a subpoena to appear before the same committee on September 13. Jason Chaffetz, R-Utah, said during a hearing Thursday that congressional subpoenas can not simply be ignored because the subject does not like the topic. He said the committee was "left with no choice" when Pagliano skipped again.

Accordingly, the Chairman of the Committee on Oversight and Government Reform recommends that the House find Mr. Pagliano in contempt for his failure to comply with the subpoenas issued to him on September 8, 2016 and September 16, 2016.

Once it was clear Pagliano would not be testifying, Republican and Democratic lawmakers spent their time hurling accusations at each other and turning the hearing into an opportunity to bash each party's nominee for president. His attorneys said in a letter to the chairman of the Oversight and Government Reform Committee that Pagliano will continue to assert his constitutional right not to testify.

Cummings has continuously charged that the hearings related to Clinton's email server are political in nature.

This Committee cannot operate - it cannot perform its duty, nor can any committee of Congress - if its subpoenas are ignored.

"His potentially fraudulent business practices?" said Rep. Elijah E. Cummings, the ranking Democrat on the committee.

In the statement, Chaffetz notes that Pagliano helped install and maintain Clinton's private email server, which was physically stored in the basement of her home in Chappaqua, New York.

On Thursday, Chaffetz noted that Pagliano was brought in in 2009 to help set up Clinton's server at her NY home.

"We can not make this government work - we can not function - if people will not adhere to the Constitution, the rules and the basic ability of the Congress to talk to these people", Mica said.

Pagliano's lawyer earlier said the committee's request was an "abuse of process".

In June, Pagliano invoked his rights under the US Constitution by refusing to answer questions at a deposition in a case brought by the conservative group Judicial Watch, which is seeking information on the content of Clinton's emails she sent and received as secretary of state from 2009 to 2013. Chaffetz shot down that argument since "he has questions that fall outside the purview of the Benghazi panel".

"Under those circumstances, Mr. Pagliano has no fear of criminal liability preventing him from testifying before the committee", Chaffetz said Thursday.
