Tom Brady to appeal 'Deflatgate' suspension again

It is uncertain whether Brady's request for an "en banc" hearing - in which a full panel of judges hears the case - will be taken up by the appeals court.

As was completely expected, Tom Brady is appealing the Second Circuit's most recent ruling which reinstated his four-game Deflategate suspension.

The suspension was originally overturned by U.S. District Court Judge Richard Berman, which allowed Brady to play last season.

Rehearing petitions are rarely granted, especially en banc petitions in this particular appeals court; the Second Circuit that traditionally awards the fewest among nation's dozen appellate courts.

The union's legal team includes former U.S. Solicitor General Theodore Olson, who appeared earlier on Monday on ABC to announce the appeal.

According to the NFLPA, Tom Brady will the appeal the \u0022Deflategate\u0022 suspension. A three judge panel from the second circuit ruled to uphold the suspension late last month.

Brady's motion on Monday said Goodell's decision would undermine labor arbitrations everywhere and "runs roughshod over the rule of law".

Brady, 38, was suspended in May 2015, four months after the National Football League (NFL) found that underinflated footballs were used in the Patriots' 45-7 victory over the Indianapolis Colts in January 2015's AFC championship game. If necessary, he said attorneys will consider asking the court for a stay. "He appointed himself to review his own decision and then he affirmed his own decision on different grounds than he specified the first time around", Olson told "GMA". The fact that the Chief Judge: (1) was one of the three judges; and (2) sided with Brady could make Brady's petition less of a long shot.

"Secondly, he ignored important provisions of the CBA [Collective Bargaining Agreement] about discipline that might be imposed for equipment violations".

"(Brady) knows he didn't do anything wrong", NFLPA Executive Director DeMaurice Smith said to ABC. "And today we're filing a brief because the commissioner chose to be a bully when it came to the fair hearing of a player".

Brady was scheduled to be banned for the first four games of 2015 after a lengthy investigation into the "Deflategate" scandal during the play-offs the previous season.
