Appeals ruling threatens key provision of North Carolina law

In a 2-1 ruling, the three-judge 4th Circuit panel said the policy violated Title IX, the federal law that prohibits discrimination in schools.

A federal appeals court has overturned a policy barring a transgender student from using the boys' restrooms at his Virginia high school. The agency has said that barring transgender students from using the bathrooms that match their gender identities amounts to a violation of Title IX.

The 4th U.S. Circuit Court of Appeals ruled on Tuesday that the Virginia school's policy is discriminatory, reversing a lower court ruling that had denied the student a preliminary injunction. On Tuesday, the court backed an Education Department directive that told schools to accommodate transgender students by allowing them to choose which bathroom to use in keeping with Title IX, the Washington Post reported.

"Today's historic decision is not only a victory for Gavin, but for all transgender young people who are being targeted by discriminatory actions - including North Carolina Governor Pat McCrory's anti-transgender HB2 law", Human Rights Campaign legal director Sarah Warbelow said in a statement. It could impact other states where similar cases have arisen.

The Transgender Law Center, which had filed a friend-of-the-court brief in the case, also praised the ruling. "With this decision", he said, "we hope that schools and legislators will finally get the message that excluding transgender kids from the restrooms is unlawful sex discrimination".

To placate Grimm, the school district paid to build a number of unisex, single-person bathrooms for all students - including Grimm - to use.
